Update: amending gender markers on federal identity documents, including passports, visas, and Global Entry cards

On January 20, 2025, President Trump signed an executive order entitled Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government. The executive order requires the federal government to "implement changes to require that government-issued identification documents, including passports, visas, and Global Entry cards, accurately reflect the holder’s sex".

The U.S. Department has issued additional guidance regarding sex markers on passports.

Update: amending gender markers on Arizona birth certificates 

Arizona law (A.R.S. 36-337) requires proof of "sex change operation" to amend the gender marker on an Arizona birth certificate. 

On August 20, 2024, a federal district court ruled that the "sex change operation" requirement was unconstitutional, violating the Equal Protection and Due Process Clauses of the Fourteenth Amendment.  The matter remains under litigation. 

Tran Legal Group is monitoring the case and preparing for the issuance of new requirements to amend gender markers on Arizona birth certificates.
